These Terms and Conditions (the "Terms") govern your use of pitonnoirbotanicals.com (the "Site"), operated by Piton Noir Botanicals ("Piton Noir Botanicals," "we," "us," or "our"). By accessing or using the Site, placing an order, or otherwise contacting us through the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

About Piton Noir Botanicals

Piton Noir Botanicals is a Boston-based brand crafting destination-inspired body oils, botanical face serums, and home fragrance, sold through our online store. The Site provides information about what we offer and lets you browse and purchase our products, subscribe to our newsletter, or contact us.

Eligibility

You must be at least 18 years old, or the age of majority where you live, to use the Site, submit a form, or place an order.

Use of the Site

We grant you a limited, non-exclusive, revocable license to access and use the Site for personal, non-commercial purposes. You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Copy, scrape, harvest, or republish content or data from the Site without our written permission.
• Attempt to gain unauthorized access to the Site, its servers, or any connected systems.
• Interfere with the operation of the Site, including by introducing malicious code or excessive automated requests.
• Submit false, misleading, or fraudulent information, or impersonate another person.

Orders, Pricing, and Payment

All prices are shown in U.S. dollars and may change without notice. We work to keep product information and pricing accurate, but errors happen. If a product is listed at an incorrect price or with incorrect information, we may cancel or refuse the order, and we will refund any amount already charged. An order is accepted when we send a shipping confirmation. Payments are processed by third-party payment processors, and we do not store your card number. Applicable sales tax is calculated at checkout. You are responsible for providing accurate shipping and contact information.

Shipping

We ship within the United States. Shipping options, costs, and estimated delivery windows are shown at checkout. Processing takes three to five business days before a package ships, and delivery estimates are provided by the carrier and are not guaranteed. Risk of loss passes to you when the carrier accepts the package. If a package arrives damaged or an item is missing, contact us within seven days of delivery with photos and your order number so we can make it right.

Returns and Refunds

Because our products are personal-care and home-fragrance items, we can accept returns only of unopened, unused products in their original packaging within 30 days of delivery. To start a return, email hello@pitonnoirbotanicals.com with your order number and we will send instructions. Return shipping is the customer's responsibility unless the item arrived damaged or we sent the wrong item, in which case we will replace it or refund it at no cost to you. Approved refunds are issued to the original payment method within ten business days after we receive the return. Opened products, gift cards, and final-sale items cannot be returned.

Product Information and Safety

Product descriptions and ingredient lists are provided for your information and may be updated as formulations change. Our products are cosmetics and home fragrances. They are not intended to diagnose, treat, cure, or prevent any disease, and statements on the Site have not been evaluated by the Food and Drug Administration. Patch-test skincare products before first use and discontinue use if irritation occurs. Keep all products out of reach of children and pets, and follow the safety instructions on each label, including those for candles, diffusers, and other home-fragrance items.

Content and Accuracy

We try to keep the content on the Site accurate and current, but it is provided for general information and may contain errors or become outdated. Nothing on the Site is professional advice for your specific situation. Photographs and illustrations are representative, and actual products, spaces, and results may vary. Reviews and testimonials reflect individual experiences and are not a guarantee of results.

Intellectual Property

All content on the Site, including text, graphics, logos, photographs, video, design, and code, is owned by or licensed to Piton Noir Botanicals and is protected by copyright, trademark, and other intellectual property laws. Limitation of Liability

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT AT ISSUE. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, including liability arising under a separate written service or purchase agreement.

Indemnification

You agree to indemnify and hold harmless Piton Noir Botanicals and its owners, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

Governing Law and Disputes

These Terms are governed by the laws of the State of Massachusetts, without regard to its conflict-of-law rules. Before filing a claim, you agree to contact us by emailing hello@pitonnoirbotanicals.com so we can try to resolve the matter informally within 30 days. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Suffolk County, Massachusetts, and you consent to the personal jurisdiction of those courts. Either party may bring an eligible claim in small claims court instead.

General Terms

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy and any written agreement you sign with us, are the entire agreement between you and us regarding the Site; a signed written agreement controls if it conflicts with these Terms. You may not assign these Terms without our consent. Headings are for convenience only.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of the page shows when they last changed. Your continued use of the Site after a change means you accept the updated Terms.
